You know what, I keep forgetting it's there. However I just find it easier to drop stuff as I keep all bags open when I'm out and about, and I can easily correct a mistake if I'm not paying that much attention.
I've had a few bad experiences with Mr. Trash Can.

there is a pop-up confirming if we really want to trash an item, if we really want to accept a trade, if we really want to customize/dedicate an item, if we really want to do this and that...
why not one to confirm that we want to drop an item? even the trash pop-up says that you will lose this item forever or something to that effect.

This one, but also include a tick box that says "Don't ask again for this specific player." Limit that effect per zone.
If a player gets scammed past that, ignore it, because that's... Ugh. I can't even comprehend words to describe how silly that notion would be.

Now I think you are talking about two different ways of looking at it? The technical one (is there anything about it in the EULA or does Anet officially do anything agains it) and the moral one (is the action of scamming someone something a 'perfect' person would do?).
Personally I prefer looking at things the second way as the first way is just an excuse why you can do it (much like people who through a loophole in the law aren't punished for commiting a crime (which isn't a crime because of the loophole)).
Free will...I think it was Sartre who said you always have a free will? Even if asked to pay money with a gun to your head, so by that logic: people who pay should be laughed at because they could also have chosen to be shot? Now I know this situation is entirely different but I just want to point out that you should watch out a little with saying such things (and I off course wanted to sound clever )
To the people laughing/pointing at those who fall for this scam. I think what you are doing is to be looked at as a 'punishment' to the person who fell for it. I also think the bible says:

I'd go with a "Do really really want to do that? There's no good reason to drop things on the ground and other people can pick them up" pop-up with a "don't show this message again" option. That way unwise players get at least one more warning, and players who are wise to that trick only get annoyed once.
